Align Law is able to assist with, and advise on, all aspects of lending activities, including commercial borrowing and lending.

Consumer lending products are generally more difficult to obtain when the purpose of the loan relates to commercial properties or property development ventures. Our banking and finance team is commercial, practical and holistic in their approach to the structuring of transactions to assist our clients in their dealings with both public and private lenders.

We have extensive experience assisting lending clients with all aspects of their business whether they have an established financial services business or are just in the process of starting one, and with everything from assisting in developing the business structure to fund set-up work and documenting the finance transactions.

Align Law is able to guide lenders and borrowers through every aspect of the commercial lending process including where the arrangement is in connection with:

  • the purchase of commercial property;
  • refinancing an existing commercial loan;
  • using equity for commercial investment purposes;
  • structuring of financial services businesses
  • preparing and drafting IMs and Sub-IMs;
  • documentation of financing transactions of all kinds, from CBD high-rise funding to domestic real estate development

Notable projects

  • PERIODIC CAPITAL RAISE

    Advised SME listed exploration and technology entities on a range of underwritten and renounceable/non-renounceable rights issues and SPPs undertaken throughout 2015 – 2017 to meet capital expenditure requirements.

  • SET UP OF MANAGED INVESTMENT SCHEMES

    Advised in the set-up of managed investment schemes (some valued at over $50 million), including the drafting of Information Memorandums and obtaining relevant ASIC approvals in compliance with the Corporations Act and ASIC regulations.

  • 400 MILLION LOAN EARLY LIGHT

    Acted as the primary advisor to the client in relation to the refinance of the $400m Stock Exchange Building in Sydney. This included reviewing and advising on financing and security documents, managing the settlement process and attending to leasing and other related issues arising from the transaction.
